Rental Terms & Conditions
BOOKING AND DEPOSIT
1.1 When booking direct with Le Manoir du Pontsec, a non-returnable deposit of 20% of the final price (incl. VAT) is required at the time of booking. Your booking deposit is payable and accepted under the French ‘arrhes’ legal definition of a deposit. Unlike the alternative and stricter ‘acompte’ legal definition, paying a deposit does NOT oblige you to complete the booking, but it is lost if you cancel your booking (notwithstanding the terms set out herein). The balance payment is due 28 days prior to arrival. Full payment for late bookings (i.e. less than 28 days before the date of arrival) is required when booking.
1.2 Le Manoir du Pontsec strongly advises guests to obtain full and comprehensive travel/holiday insurance, including cancellation cover, personal accident, cover for use of the property, and for vehicle breakdown cover (if required). We advise all UK citizens to ensure they have at least a valid EHIC card for medical emergencies. Any claims must be made directly to your insurers and Le Manoir du Pontsec does not accept liability in relation to loss and damage to your property as a result of your stay.
1.3 For direct bookings Le Manoir du Pontsec accept direct bank transfer as deposit/payment.
1.4 Your booking is secure once Le Manoir du Pontsec has received a completed booking form and deposit or full payment for late bookings. This constitutes a legally binding contract between Le Manoir du Pontsec and the person booking. No reservation will be made until the completed booking form and deposit has been received. The deposit is non-refundable.
1.5 When booking through a third-party site, the exact amount payable at booking will depend on the terms and conditions of that site.
SECURITY DEPOSIT
2.1 A security deposit of €1725 must be paid at least 7 days prior to arrival. This amount will be fully refunded within 7 days after a full inspection of the property after your departure, provided there is no damage to the property or items missing.
2.2 Upon arrival and departure, guests will be given an itinerary to fill out and sign. Upon completion please hand this to the housekeepers as soon as possible. Any loss or damage to the property, furniture, fittings or effects must be accounted for in the departure itinerary.
2.3 Guests shall report to the housekeepers without delay, any defects in the property or equipment so that repair/replacement can be made as soon as possible.
2.4 Keys to the property will be given to guests upon arrival and must be returned to the housekeepers upon departure. Any loss or damage to the keys will result in a €50 charge.
2.5 At the end of your stay, the property including all its furniture, fittings and effects must be left in the same condition and state as they were found. Any loss or damage to the property during your stay must be reported to the housekeepers. Le Manoir du Pontsec reserve the right to claim from you for any loss of future business as a result of damage during your stay, however this is so caused.
2.6 We reserve the right to terminate the rental agreement immediately and without compensation or refund if guests:
2.6.1 damage the premises;
2.6.2 are excessively noisy or disturb others;
2.6.3 are found to be, or are reasonably suspected to be, breaking the law;
2.6.4 allow any one to stay at the Property without our permission;or
2.6.5 do not comply fully with these terms and conditions.
ARRIVAL AND STAY
3.1 The rental period shall commence at 14:00h on the first day of the booking, and end at 10.00am on the last day of the booking (the ‘Rental Period’). Outside of the Rental Period, Le Manoir du Pontsec shall not be obliged to:
3.1.1 offer accommodation to guests; and
3.1.2 allow guests to stay in occupation;
3.2 Guests are advised to arrive between 14:00h and 18:00h on the day of arrival (unless prior arrangements have been made) and to notify Le Manoir du Pontsec for any delay of arrival.
3.3 The maximum occupancy for each property is: 14 persons in the maison (main house) and 4 persons in the cottage. These numbers must not be exceeded. The maximum occupancy permitted includes babies and small children.
3.4 Guests must abide by the rules regarding the use of the facilities set out in Schedule 1 of these terms and conditions. On arrival, guests must be inducted to all facilities of the house. If guests are subsequently unsure how to use any of the equipment, please ask the housekeepers.
3.5 Visitors are permitted with prior notice to the housekeepers; however visitors are not permitted to stay or have any use of the facilities including the gym or the swimming pool without Le Manoir du Pontsec’s permission. Any breach of the rules by visitors will be a breach attributable to guests.
3.6 Pets are not permitted at any time during your stay.
3.7 Smoking is not permitted within any of the buildings. Smoking is permitted outside only, at least 5m from any of the buildings.
3.8 Shoes are not permitted anywhere in the buildings except for the gym. It is recommended that you wear slippers when walking around the house, these are only to be worn inside the house.
3.9 If you have been swimming, you must ensure your feet are dry before entering the house. Please be aware that the floors can be slippery when wet.
3.10 If using the barbeque, guests must ensure it is safely extinguished after use and cleaned to the standard it was found. Persons under 18 years old are not permitted to use the barbeque.
CANCELLATIONS
4.1 Any cancellation by you must be provided in writing; email is acceptable as long as a confirmation of receipt is provided by Le Manoir du Pontsec. The effective date of cancellation is the date we receive written notification before 16:30h local time. Any monies already paid will not be refunded.
4.2 In the extremely unlikely event of a significant change or cancellation of your booking by us, we will inform you as soon as possible. A full refund of all monies paid by you will be given within 14 days.
OUR LIABILITY
5.1 In the event of circumstances beyond Le Manoir du Pontsec’s reasonable control e.g. (but not limited to) fire, flood, exceptional weather conditions, loss of electricity/internet connection, disease outbreaks, industrial disputes etc. Le Manoir du Pontsec shall not be liable for any resulting costs, losses or damages suffered by you (including the cost of securing alternative accommodation), nor for its failure to undertake its obligations to you. However, in appropriate cases, Le Manoir du Pontsec will refund your payments to you.
5.2 Le Manoir du Pontsec cannot be held responsible for injury as a result of failing to adhere to the rules herein surrounding using the premises safely.
5.3 Guests use the buildings, grounds and facilities at their own risk. Guests should expect to encounter some potential minor hazards such as uneven ground, mud, etc. which should be reasonably contemplated at such a property.
5.4 Any valuables left at the property are left at your own risk. Le Manoir du Pontsec are not responsible for any loss. Proper care must be taken against theft and burglary. It is essential, and also the guests’ responsibility, to ensure that all doors, shutters and windows are closed and locked when leaving the property, or when walking in the grounds. No refund will be given should guests decide to vacate the property as a consequence of a burglary. Le Manoir du Pontsec does not accept any liability in relation to loss and damage to guests’ belongings as a result of their stay.
5.5 Le Manoir du Pontsec cannot be held responsible for any delays or cancellations that are a result of individual government restrictions which are a result of any emergency legislation enacted or any government advice in relation to Covid-19 or any coronavirus. However, Le Manoir du Pontsec reserve the right to amend your booking as it sees fit.
SCHEDULE 1 USE OF THE FACILITIES
THE SWIMMING POOL (salt-water non-heated pool)
1.1. When using or by the pool, all children under 16 years must be kept under supervision and accompanied at all times.
1.2. Le Manoir du Pontsec expects guests to exercise caution around the swimming pool and to supervise any children in and around the swimming pool. Le Manoir du Pontsec cannot be held responsible for any injury caused as a result of unsafe behaviour or inadequate supervision.
1.3. Where necessary, children must wear appropriate floatation devices such as plastic floats or armbands.
1.4. Running is not permitted by the pool.
1.5. Diving is not allowed in the pool.
1.6. Guests should not use the pool when under the influence of alcohol, drugs or any medication that may affect your safety.
1.7. When the pool is not being used, the pool alarm must be activated. The functionality of the pool alarm will be explained to guests upon arrival. It is essential that the demonstration is understood, however, be aware that this does not substitute guests’ responsibility for theirs and others’ safety.
1.8. Guests must inform us if they have sustained an injury elsewhere or have developed a medical condition that may have consequences for swimming.
1.9. Guests must always keep a phone near the pool in case of emergencies, the universal French emergency number is 112.
1.10. Music can be played by the pool between 10:00am-22:00h, please respect the noise level for neighbours.
THE GYM
2.1 Guests’ use of the gym facilities is at their own risk. If guests are unsure how to use any of the equipment, please ask the housekeeper. We advise against using the gym facilities alone.
2.2 Guests must inform us if you have sustained an injury elsewhere or have developed a medical condition that may have consequences for use of the gym equipment.
2.3 When using the equipment, suitable gym clothing and clean trainers must be worn at all times.
2.4 Equipment must be treated with respect. Please refrain from dropping weights or placing weights against the wall. Equipment should be replaced after use.
2.5 Machines and equipment must be wiped down using the clearing materials provided after use, left clean and dry and replaced in the correct area.
2.6 Guests must not use the gym when under the influence of alcohol, drugs or any medication that may affect their safety.
2.7 No one under the age of 12 is permitted to use the gym. Children aged between 12-15 must be accompanied by an adult.
2.8 Playing of music on the stereo system is allowed between 10:00h-22:00h, please respect the noise level for neighbours.
BIKE HIRE
3.1 Any loss or damage to the bikes will result in a charge dependent on cost to repair or replace.
3.2 Bikes must be adjusted to suit each individual prior to use.
3.3 Bikes are not to be used within the pool area.
3.4 If you notice any fault with your bike before or during your cycle ride, you must inform a housekeeper as soon as possible so that a repair or replacement bike can be provided before your next excursion.
3.5 The helmets provided by Le Manoir du Pontsec must be worn at all times when cycling.
3.6 If cycling at night or during adverse weather conditions, please ensure safety lights are switched on and you are wearing suitable reflective clothing.
3.7 Guests must inform us if they have sustained an injury elsewhere or have developed a medical condition that may have consequences for cycling.
POOL TABLE
4.1 The pool table has a slate bed and has been levelled. Please refrain from moving the table.
4.2 Do not sit on the cushions or place any objects on the table.
4.3 In the event the pool table is damaged, e.g. the baize (cloth) is torn, please notify the housekeepers.
FOSSE SEPTIC
5.1 The house has a septic tank which means that nothing other than human waste and septic safe toilet paper should be flushed into the septic tank.
